Effective Date: September 15, 2026
Last Updated: September 15, 2026
Governing Law: State of New York
Platform Age Restriction: 18+
1. Your Agreement With PO
These Terms of Use (“Terms”) form a legally binding agreement between you (“you,” “your,” or “User”) and PO Network Inc. (“PO,” “we,” “our,” or “us”).
These Terms govern your access to and use of the PO mobile application, website, livestreaming features, creator features, monetization features, and related products and services (collectively, the “Platform”).
By creating an account, accessing, purchasing through, or otherwise using PO, you agree to these Terms and to policies incorporated into these Terms by reference, including PO’s Privacy Policy, Community Guidelines, DMCA Policy, and any additional rules presented in connection with particular Platform features.
If you do not agree to these Terms, you must not access or use the Platform.
2. Age Restriction – 18+ Only
PO is intended exclusively for individuals who are 18 years of age or older.
By creating an account or using PO, you represent that you are at least 18 years old and legally capable of entering into these Terms.
PO does not knowingly permit individuals under 18 to create or maintain accounts. If PO determines or reasonably believes that an account belongs to an individual under 18, PO may suspend or terminate the account and take appropriate action concerning associated information in accordance with our Privacy Policy and applicable law.
3. Your Account
You are responsible for maintaining the confidentiality and security of your PO account and for activity occurring through your account.
You agree to provide accurate information where required, maintain accurate account information, protect your login credentials, and promptly notify PO if you become aware of unauthorized access to or use of your account.
You may not impersonate another person, materially misrepresent your identity, create accounts for fraudulent or abusive purposes, sell or transfer an account in violation of PO policies, or use another person’s account without authorization.
PO may require account, age, identity, payment, payout, or other verification where reasonably necessary for security, monetization, legal compliance, fraud prevention, or access to particular Platform features.
4. Platform Features
PO is a social content and creator platform that may provide features including photos, videos, categories, comments, reactions, direct messaging, livestreaming, collaborative livestreaming, YouTube integration, virtual gifts, creator earnings, advertising, Boost features, streaming plans, and other social or creator tools.
Features may differ by device, operating system, account status, geographic region, eligibility, technical availability, or applicable law.
PO may add, modify, suspend, limit, replace, or discontinue Platform features as the Platform develops, subject to applicable law.
5. User-Generated Content
PO allows users to create, upload, publish, transmit, livestream, display, or share content (“User Content”), which may include photos, videos, livestreams, captions, categories, comments, messages, profile information, and other materials.
You retain ownership of the User Content you create, subject to the rights you grant to PO under these Terms.
By submitting or making User Content available through PO, you grant PO Network Inc. a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt as technically necessary, transmit, display, distribute, and otherwise use that User Content as reasonably necessary to operate, secure, improve, provide, and promote the Platform and its features.
This license does not transfer ownership of your User Content to PO.
You represent that you own your User Content or possess the rights, permissions, licenses, and authorizations necessary to submit and use it through PO and to grant the rights described in these Terms.
6. Responsibility For Your Content
You are responsible for User Content you create, upload, publish, transmit, or livestream through PO.
You must not upload, publish, transmit, or livestream material that violates applicable law, infringes intellectual-property or privacy rights, violates these Terms or PO policies, or otherwise constitutes prohibited activity.
PO does not endorse or guarantee the accuracy, truthfulness, reliability, or legality of opinions, categories, comments, statements, or other User Content submitted by users.
Categories, reactions, category selections, opinions, and similar interactions represent user-generated expression and engagement and should not be interpreted as factual determinations or endorsements by PO concerning any individual, product, service, organization, or subject.
7. Copyright And Media Rights
You may upload, publish, or livestream only content that you own or are legally authorized to use.
This requirement applies to music, sound recordings, photographs, videos, artwork, trademarks, copyrighted works, and other protected materials.
You are responsible for obtaining any licenses, permissions, releases, or other rights required for your User Content.
PO does not obtain copyright licenses or other permissions on your behalf merely because content can technically be uploaded or streamed through the Platform.
Repeated infringement may result in content removal, feature restrictions, account suspension, or account termination in accordance with PO’s DMCA Policy and applicable law.
8. Prohibited Content And Conduct
You may not use PO to create, upload, distribute, promote, facilitate, or engage in unlawful or prohibited activity.
Prohibited activity may include:
- Illegal content or illegal activity;
- Sexual exploitation, nudity, or sexually explicit material prohibited by PO policies;
- Hate speech, unlawful discrimination, harassment, bullying, or abusive conduct;
- Credible threats, incitement of violence, or promotion of illegal violence;
- Fraud, scams, deceptive schemes, or attempts to steal money, credentials, or information;
- Spam, malicious automation, bots, or unauthorized artificial engagement;
- Impersonation or materially deceptive identity practices;
- Copyright, trademark, privacy, publicity-right, or other intellectual-property violations;
- Attempts to manipulate Platform metrics, gifts, advertising, earnings, views, engagement, or monetization systems;
- Attempts to evade moderation through intentionally disguised prohibited material;
- Malware, malicious code, unauthorized access attempts, interference with Platform systems, or other security abuse; or
- Other conduct prohibited by PO’s Community Guidelines or applicable law.
PO may investigate suspected violations and take appropriate action, including blocking content before publication, removing or restricting content, limiting Platform features, suspending accounts, terminating accounts, restricting transactions or withdrawals while legitimate investigations are conducted where permitted by law, or reporting conduct to appropriate authorities where required or appropriate.
9. Categories, Opinions, And Community Interactions
PO allows users to create or interact with categories, opinions, reactions, category selections, and other engagement features associated with content.
Where PO permits a content owner to create or select categories for their content, those categories are user-selected and do not represent an evaluation, endorsement, factual conclusion, or judgment made by PO Network Inc.
User interactions are subjective expressions of individual users. PO does not guarantee that user-generated opinions, categories, reactions, category selections, or other engagement information are accurate, representative, or fair.
Users may not manipulate engagement through bots, coordinated fraudulent activity, purchased engagement, duplicate accounts, or other artificial means.
10. Direct Messages And Communications
PO may provide direct-messaging and other communication features between eligible users.
You may not use communication features for harassment, threats, spam, fraud, sexual exploitation, illegal activity, or other conduct prohibited by these Terms or PO policies.
PO may use automated safety systems and, where appropriate, human review to investigate reported or potentially prohibited communications as described in PO’s Privacy Policy.
Users should exercise appropriate caution when communicating with other users and should not provide passwords, financial credentials, or other sensitive information to unknown persons.
11. Livestreaming And Live Collaboration
Eligible users may be permitted to livestream through PO, including through Solo Live and supported collaborative livestreaming features.
Livestreaming does not exempt users from these Terms or PO’s Community Guidelines.
Users must not broadcast prohibited content, including unlawful material, prohibited sexual or explicit content, hate or harassment, threats or prohibited violence, fraud, dangerous illegal activity, or content that infringes third-party rights.
PO may interrupt, restrict, or terminate a livestream where PO reasonably determines that the broadcast violates Platform rules, presents a safety or legal concern, or is associated with suspicious or abusive activity.
PO does not guarantee uninterrupted livestream availability, minimum audience size, advertising availability, monetization, or any particular technical performance.
12. Digital Purchases Through Apple And Google
PO may offer digital products, virtual items, subscriptions, plans, or Platform features for purchase.
These may include:
- PO Coins or Points used for eligible virtual gifts or other supported Platform functions;
- Boost plans or other promotional visibility features;
- Streaming plans, including the $4.99 plan providing 800 streaming minutes; and
- Other digital products or Platform features PO may introduce.
Purchases made within PO’s iOS application are processed through the applicable Apple App Store purchasing system. Purchases made within PO’s Android application are processed through the applicable Google Play purchasing system.
The applicable store provider processes the underlying payment method. PO may receive transaction information necessary to verify and provide purchased products or features but does not receive the complete payment-card credentials used by the applicable store provider.
Pricing, taxes, currency conversion, payment authorization, billing, refunds, charge disputes, and other transaction matters may be subject to Apple’s or Google’s applicable rules and policies.
PO may modify available products, package sizes, pricing, or features prospectively, subject to applicable store rules and applicable law.
13. PO Coins, Points, And Virtual Gifts
PO may allow users to purchase or otherwise obtain PO Coins or Points and use them for eligible virtual goods or gifts within the Platform.
PO Coins or Points are Platform-based digital items. They are not bank deposits, stored-value accounts, cryptocurrency, legal tender, or general-purpose money and may not be transferred, exchanged, or used outside PO except as expressly permitted by PO.
Purchased PO Coins or Points generally have no cash redemption value for the purchaser and may not be redeemed by the purchaser for cash unless required by applicable law.
When a user sends an eligible virtual gift to a creator, PO may credit the creator with eligible creator earnings according to PO’s then-current creator monetization rules.
The amount paid by a purchaser for Coins or Points is not necessarily equal to the amount ultimately eligible for creator payout. App-store commissions or charges, taxes, Platform allocations, adjustments, refunds, chargebacks, fraud reviews, and other applicable factors may affect creator earnings.
Refunds for purchases are subject to applicable law and the rules and procedures of the applicable app store through which the purchase was processed.
14. Creator Gift Earnings
Eligible creators may earn redeemable balances from qualifying virtual gifts received through supported PO features.
Under PO’s current creator-gift structure, eligible creators may receive 70% of the applicable net gift value remaining after applicable app-store charges or commissions, with PO retaining the applicable Platform share.
Creator earnings displayed within PO may be pending, estimated, adjusted, or subject to verification before becoming eligible for withdrawal.
PO may adjust balances where reasonably necessary to account for refunds, chargebacks, fraudulent transactions, technical errors, duplicate credits, policy violations, store adjustments, or other legitimate corrections.
Creator participation in monetization features may be subject to eligibility requirements, identity verification, account standing, minimum payout thresholds, geographic availability, third-party provider requirements, and applicable law.
15. Livestream Advertising Revenue
PO may display advertising in connection with livestreaming through Google AdMob or other disclosed advertising providers.
Under PO’s current livestream revenue-sharing program, an eligible creator may receive 50% of eligible verified net advertising revenue attributed by PO to that creator’s livestream.
Advertising revenue may depend on factors including advertiser demand, eligible impressions, viewer activity, geographic location, ad availability, invalid-traffic detection, adjustments, and reporting from PO’s advertising providers.
Displayed or preliminary earnings may change before finalization.
PO does not guarantee that advertisements will appear during every livestream or that any livestream will generate revenue.
PO may make reasonable adjustments to creator advertising balances based on finalized provider reports, invalid traffic, refunds, reporting corrections, fraud, technical errors, or other legitimate reconciliation requirements.
16. Creator Earnings Are Not Guaranteed
Participation in PO does not guarantee income, advertising revenue, gifts, audience growth, views, engagement, or any other financial result.
Creator earnings may vary significantly and may be affected by user activity, advertising demand, third-party provider rules, app-store commissions, refunds, fraud reviews, technical conditions, eligibility requirements, and other factors.
Nothing in these Terms creates an employment relationship between PO and a creator. Unless otherwise required by applicable law, creators participate as independent users of the Platform and are responsible for their own tax and legal obligations arising from their earnings.
17. Creator Verification And PayPal Hyperwallet Payouts
PayPal Hyperwallet is used for eligible creator withdrawals and payouts. It is not PO’s processor for ordinary user purchases made through the iOS or Android applications.
Before withdrawing eligible creator earnings, a creator may be required to establish a payout profile and successfully complete identity, tax, banking, sanctions, or other verification required by PO, PayPal Hyperwallet, financial institutions, or applicable law.
Verification requirements may include legal name, email address, date of birth, residential address, country, tax information, government identification or other identity information, and banking or payout information.
A creator may be unable to withdraw earnings until required verification has been completed.
Eligible creator balances may include qualifying virtual-gift earnings and qualifying livestream advertising revenue.
Payouts are processed through PayPal Hyperwallet and may be subject to availability, verification requirements, minimum thresholds, processing times, supported countries, payout methods, provider rules, and applicable fees.
PO may receive information from Hyperwallet concerning verification status, payout eligibility, payout amounts, payout status, transaction identifiers, or other information reasonably necessary to administer creator payouts.
PO does not guarantee a specific payout-processing time where processing depends on Hyperwallet, banks, financial institutions, regulatory review, or other third parties.
18. Taxes
Creators are responsible for determining and satisfying taxes, reporting obligations, registrations, and other governmental requirements applicable to their creator earnings, except where PO or a payment provider is legally required to report, collect, deduct, or withhold amounts.
PO and/or PayPal Hyperwallet may request tax information and may provide tax reporting to creators or governmental authorities where required by applicable law.
Creators are responsible for ensuring that legal, tax, identity, and payout information they provide is accurate and current.
19. Monetization Fraud And Manipulation
Users may not manipulate or attempt to manipulate PO’s monetization systems.
Prohibited conduct includes fake views, bot traffic, artificial engagement, coordinated fraudulent gifting, payment fraud, chargeback abuse, ad manipulation, self-generated invalid advertising activity, fabricated transactions, exploitation of technical errors, or attempts to circumvent payout or eligibility controls.
PO may investigate suspicious monetization activity and may temporarily restrict withdrawals or monetization while a legitimate investigation is pending where permitted by law.
If PO determines that earnings resulted from fraud, invalid activity, refunds, chargebacks, technical errors, or other ineligible activity, PO may make appropriate corrections to affected balances consistent with applicable law and third-party provider requirements.
Serious or repeated violations may result in loss of monetization privileges, suspension, or account termination.
20. Boost And Promotional Features
PO may offer paid Boost plans or similar promotional features designed to increase the opportunity for eligible content or accounts to receive additional visibility within the Platform.
Purchasing a Boost does not guarantee a particular number of views, followers, reactions, gifts, sales, earnings, ranking position, or other outcome unless PO expressly states a specific guaranteed delivery metric at the time of purchase.
Boosted content remains subject to PO’s Terms, Community Guidelines, moderation systems, and eligibility requirements.
21. Streaming Plans And Minutes
PO may require or offer streaming-minute plans for certain livestream functionality.
PO currently offers a $4.99 streaming plan providing 800 streaming minutes, subject to availability and the pricing displayed in the applicable application store.
Streaming minutes are digital Platform entitlements and do not represent money, creator earnings, or cash-equivalent value.
Usage calculations may depend on PO’s technical systems and may be subject to reasonable corrections for verified technical errors.
PO may introduce, modify, or discontinue streaming packages prospectively, subject to applicable law and applicable app-store requirements.
22. Advertising And Third-Party Services
PO may use third-party providers for advertising, hosting, infrastructure, media delivery, authentication, analytics, moderation, communications, purchases, verification, and payouts.
These providers may include Apple, Google, YouTube, Google AdMob, PayPal Hyperwallet, and other service providers.
Third-party services operate under their own terms, policies, technical requirements, and availability.
PO is not responsible for outages, delays, policy decisions, account restrictions, processing failures, or other matters controlled independently by third-party providers, except to the extent responsibility cannot legally be excluded.
23. YouTube And Google Integration
PO uses YouTube API Services and may provide functionality that allows users to connect a Google or YouTube account, authorize supported functionality, upload supported videos to their own YouTube channel, share supported YouTube links with PO, and display or embed YouTube-hosted videos within the Platform.
Authentication and authorization may be provided through Google OAuth.
Videos hosted by YouTube remain hosted by YouTube and remain subject to the user’s YouTube account settings and applicable YouTube rules.
Use of YouTube-related features is also subject to the YouTube Terms of Service.
Users should also review the Google Privacy Policy.
PO does not control whether YouTube makes a particular video embeddable, available, restricted, removed, or otherwise accessible through YouTube services.
If YouTube removes, restricts, disables embedding for, or otherwise makes content unavailable, the affected content may no longer function or display through PO.
Information concerning PO’s access to, use of, retention of, and deletion of Google/YouTube user data is described in PO’s Privacy Policy.
24. Moderation, Reporting, And Enforcement
PO may use automated moderation systems, filtering technology, user reports, and human review where appropriate to identify content or activity that may violate these Terms, PO policies, or applicable law.
Moderation may apply to supported content and features including posts, captions, categories, comments, direct messages, livestreams, profile information, and other user-generated material.
Users may report supported content, accounts, comments, messages, or activity through available reporting mechanisms.
Depending on the circumstances, PO may prevent content from being submitted, restrict distribution, remove content, terminate a livestream, issue warnings, restrict features, temporarily suspend an account, permanently terminate an account, restrict monetization, or take other appropriate action.
Automated moderation systems are not infallible. Where PO provides an appeal process, users may request review of eligible enforcement actions through available Platform functionality or by contacting PO support.
25. Account Suspension And Termination
PO may suspend, restrict, or terminate an account when reasonably necessary because of violations of these Terms or PO policies, fraud, security threats, illegal activity, repeated infringement, abuse of Platform systems, legal requirements, or material risks to PO, users, or third parties.
Where appropriate and legally permitted, PO may use warnings or temporary restrictions before permanent termination. Serious violations may justify immediate action.
Termination or restriction of an account may result in loss of access to Platform features and User Content associated with that account.
Treatment of legitimate creator earnings following suspension or termination will depend on the circumstances, including pending verification, fraud investigations, refunds, chargebacks, legal requirements, provider restrictions, and whether the earnings were validly earned.
26. Account Deletion
Users may request deletion of their PO account using available account-deletion functionality or by contacting info@povote.com.
Account deletion may permanently remove or de-identify information associated with the account, subject to PO’s Privacy Policy and applicable legal retention requirements.
Certain information may be retained where reasonably necessary for security, fraud prevention, financial reconciliation, accounting, tax compliance, dispute resolution, moderation history, legal obligations, or enforcement.
Some interactions may remain in anonymized or de-identified form where permitted by law and technically appropriate.
27. Intellectual Property
Except for User Content and third-party materials, PO’s software, source code, interfaces, designs, graphics, logos, trademarks, branding, systems, documentation, and other proprietary Platform materials are owned by or licensed to PO Network Inc. and are protected by applicable intellectual-property laws.
These Terms do not grant you ownership of PO’s intellectual property.
Except where expressly permitted by law or PO in writing, you may not copy, reproduce, distribute, sell, license, modify, reverse engineer, decompile, circumvent, or exploit PO’s proprietary Platform technology or materials.
28. DMCA And Copyright Complaints
PO Network Inc. respects intellectual-property rights and responds to copyright complaints in accordance with applicable law, including the Digital Millennium Copyright Act (“DMCA”) where applicable.
If you believe material available through PO infringes a copyright that you own or are authorized to enforce, you may submit a copyright complaint to info@povote.com.
A DMCA notice should include the information required by applicable law, including:
- Identification of the copyrighted work claimed to have been infringed;
- Identification and location of the material claimed to be infringing;
- Your name and contact information;
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf; and
- Your physical or electronic signature.
PO may remove or restrict access to material in response to a valid copyright complaint and may take action against repeat infringers in accordance with PO’s DMCA Policy and applicable law.
Users whose content is removed in response to a DMCA notice may have rights to submit a counter-notification where permitted by law and as described in PO’s applicable DMCA procedures.
29. Privacy
PO’s collection, use, disclosure, retention, and protection of personal information is described in the PO Privacy Policy.
By using the Platform, you acknowledge that information will be handled as described in the Privacy Policy and in accordance with applicable law.
Third-party services integrated with PO may independently collect or process information under their own privacy policies and terms.
30. Accessibility
PO Network Inc. seeks to make the Platform accessible to users and to improve usability across supported devices and assistive technologies.
If you encounter an accessibility issue while using PO, you may contact us at info@povote.com or support@povote.com.
31. Platform Availability And Changes
PO may update, modify, add, remove, suspend, or discontinue features or portions of the Platform for technical, security, legal, operational, or business reasons.
PO does not guarantee that every feature will always be available or that the Platform will operate without interruption or error.
Maintenance, internet conditions, third-party outages, security events, technical failures, governmental restrictions, or circumstances outside PO’s reasonable control may affect availability.
Where reasonably appropriate, PO may provide notice of material changes affecting users, but advance notice may not always be possible.
32. Disclaimer Of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
PO NETWORK INC. DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PO DOES NOT WARRANT THAT THE PLATFORM WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS, OR THAT USER CONTENT, CREATOR EARNINGS, ADVERTISING, ENGAGEMENT, OR OTHER PLATFORM RESULTS WILL MEET A USER’S EXPECTATIONS.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.
33. Limitation Of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PO NETWORK INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
This may include, to the extent permitted by law, losses involving data, content, business opportunities, anticipated earnings, advertising revenue, reputation, or Platform availability.
PO is not responsible for User Content or for actions, statements, transactions, or conduct of other users, except to the extent applicable law imposes responsibility that cannot be excluded.
PO is also not responsible for failures or delays caused independently by third-party services such as Apple, Google, YouTube, Google AdMob, PayPal Hyperwallet, internet providers, financial institutions, or other external services, except to the extent responsibility cannot legally be excluded.
TO THE FULLEST EXTENT PERMITTED BY LAW, PO NETWORK INC.’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO PO, IF ANY, DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by applicable law.
34. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PO Network Inc. and its officers, directors, employees, agents, and affiliates from claims, liabilities, damages, losses, and reasonable costs and expenses, including reasonable attorneys’ fees, arising from or relating to:
- Your User Content;
- Your material violation of these Terms;
- Your violation of applicable law;
- Your infringement or violation of another person’s intellectual-property, privacy, publicity, or other legal rights; or
- Your fraudulent, abusive, or unauthorized use of the Platform.
This provision does not require you to indemnify PO for conduct for which indemnification cannot lawfully be required.
35. Changes To These Terms
PO may revise these Terms to reflect changes to the Platform, products, monetization programs, third-party services, legal requirements, safety practices, or business operations.
When these Terms are updated, PO will revise the “Last Updated” date above and may provide additional notice of material changes where required by applicable law.
Where applicable law requires affirmative consent to a material change, PO will request that consent.
Otherwise, continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
36. Governing Law And Venue
These Terms and disputes arising out of or relating to these Terms or the Platform are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law provides otherwise.
Subject to any rights or jurisdiction that cannot lawfully be waived, legal proceedings arising out of or relating to these Terms or the Platform shall be brought in the applicable state or federal courts located in New York County, New York.
You and PO consent to the jurisdiction and venue of those courts, subject to applicable non-waivable legal rights.
37. Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed from these Terms.
The remaining provisions will continue in full force and effect.
38. No Waiver
PO’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or PO’s right to enforce it later.
A waiver by PO is effective only to the extent expressly provided by PO and does not constitute a continuing waiver unless expressly stated.
39. Assignment
You may not assign or transfer your rights or obligations under these Terms without PO’s prior written consent where such restriction is permitted by law.
PO may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, change of control, or similar business transaction, subject to applicable law.
40. Entire Agreement
These Terms, together with PO’s Privacy Policy, Community Guidelines, DMCA Policy, and any additional terms expressly applicable to specific Platform features, constitute the agreement between you and PO concerning your use of the Platform.
If additional terms applicable to a particular PO feature conflict with these general Terms, the feature-specific terms will control with respect to that feature to the extent of the conflict.
41. Third-Party Platform Terms
Your use of PO through an Apple or Google device or application marketplace may also be subject to applicable terms and policies of Apple or Google.
Nothing in these Terms is intended to override mandatory requirements imposed by an applicable application marketplace or applicable law.
Third-party products and services accessible through or integrated with PO remain subject to the applicable third party’s terms and policies.
